Interbio Technologies (PT International Biometrics Indonesia, next referred as “we”, “our”, “us” or “Interbio”) commits to protecting your personal information when you interact with us. This Privacy Policy explains our practices in collecting and using your data, across our website (www.interbio.id). Hence, Interbio has developed a Privacy Policy for all users (“User”, “you”, “your”, or “yours”) of its websites to describe how we collect, use, disclose, store, and transfer your personal data and information (“Personal Information”) in accordance with the Indonesian prevailing regulations concerning Personal Data Protection.

1. ABOUT THIS PRIVACY POLICY

This Privacy Policy provides an overview of the handling of your Personal Information managed by Interbio. We created this Privacy Policy to inform Users these followings:

a. What Personal Information Interbio might collect about Personal Information from its website;
b. What Interbio might do with Personal Information; and
c.  User’s choices about Personal Information the User provides.

Interbio is entitled, at Interbio’s discretion, to change, modify, add, or remove the provisions in this Privacy Policy from time to time. In the event of any inconsistency with other Interbio’s policies regarding data, information, and system security measures, this Policy shall prevail.

If any provision of the terms in this Policy is found to be invalid, void, or unforceable, the remaining provisions hereof will not be affected, and such invalid, void, or unforceable provision will be amended by Interbio and adjusted to prevailing laws and regulations.

2. COLLECTION OF PERSONAL INFORMATION

Personal information is each and every information that is used to identify individuals either separately or in combination with any other information directly or indirectly through electronic or non-electronic systems.

Prior to and during your use of our website and services, some Personal Information is collected, manually or automatically, with your consent, these include but are not limited to:

a. Information you give to us through Contact Us form: Name, email, phone number, message, company;
b. Information you give to us through info@interbio.id: Name, email, phone number, message, company; and
c. Personal information about you from our partners/third parties.

While we collect the Personal Information from you, we can also combine the collected Personal Information with other information in our possession or that we may receive from third party sources, including marketers, partners, affiliates, and our clients, as per the law to share your Personal Information with us.

4. DISCLOSURE OF PERSONAL INFORMATION

We disclose your Personal Information to other parties listed in this section. Depending on Indonesian prevailing law that applicable to you, some of these disclosures may potentially constitute a “transmission” of your Personal Information. We never sell or rent your Personal Information we process about you.

Your personal information may be disclosed to third parties for number of business purposes, such as:

  1. Internal Interbio, including the shareholders, the Board of Commissioners, the Board of Directors, and employees appointed for the internal and administrative purposes of Interbio;
  2. Interbio’s affiliates, including the parent company and/or subsidiaries of Interbio, including but not limited to third-party service providers who are required to keep your information confidential and secure and are restricted from using or disclosing information for reasons other than performing services on Interbio’s behalf or to comply with legal requirements;
  3. If, in good faith, disclosure is appropriate to comply with applicable law or legal process;
  4. In connection with a change in ownership or control of all or a part of our business (such as a merger, acquisition, reorganization, or bankruptcy);
  5. Between and among Interbio and our current and future parents, affiliates, subsidiaries, and other companies under common control or ownership;
  6. Marketing services;
  7. Internal Legal advisers;
  8. Government, regulatory and law enforcement agencies to meet our compliance, regulatory, and risk management obligations or to comply with the law; or
  9. For any other purpose with your consent or at your direction.

Interbio will not share your Personal Information to be available for public, including parties related to insurance company. However, if you share your Personal Information to other parties, they may have other policies to use Personal Information which is not connected or different to our policies as stipulated in this Privacy Policy. Please review the Privacy Policy that the other parties have provided carefully. Interbio is not responsible for any consequences occurred upon your choice to share Personal Information to other parties.

5. RETENTION LIMITATION

Your personal information will be stored and kept for as long as necessary for the above purposes (the retention period and the considerations for determining it can be varied).

We will terminate the retention period or remove your personal information when it is no longer necessary for any legal or business purposes. You have the right at any time to request that Interbio terminate the processing, delete, and/or destroy Personal Information and InterBio shall comply with your request no later than 7 (seven) business days from the receipt of the request.

6. ACCESSING PERSONAL INFORMATION

When requested in writing, we will inform you of the existence, use, and disclosure of Personal Information that Interbio maintains. We may not be able to provide you with all the information you request, depending on the circumstances, and there may be a charge for copies of Personal Information request. Interbio is obliged to grant such access no later than 3×24 (three times twenty-four) hours after Interbio has received the request from the User. However, Interbio shall refuse to grant such access to Personal Information if it endangers security, affects the disclosure of Personal Information belonging to other parties and/or conflicts with the interests of national defence and security, as provided for in Law No. 27 of 2022 on The Protection of Personal Data.

7. HOW WE KEEP YOUR PERSONAL INFORMATION SAFE

We implement the highest standards in our best efforts for security practices in order to protect your Personal Information from accidental unauthorized access, use, collection, disclosure, or modification. We make an access limitation to your Personal Information for our employees, partners, legal advisers, or other third parties. However, sending information over the internet is not completely secure. Although Interbio will try its best to protect your Personal Information, you are acknowledged that Interbio cannot guarantee the integrity and accuracy of any Personal Information that any individual submits through our website.

We use reasonable physical, technological, organizational and contractual safeguards, appropriate to the sensitivity of the information, to protect Personal Information in Interbio’s possession or under our control, from unauthorized access, disclosure, or use. We implement the standard of Personal Information policy. Personal Information may be saved in our database as necessary to provide the services. We will provide security to protect and secure all Personal Information in our website according to Indonesian prevailing laws and regulations.

We restrict access to our personnel, affiliates, or representatives. We limit access to your information only to authorized parties based on their functions and job descriptions. We also require the appointed party to implement and maintain Personal Information administratively, physically and technically.

8. MANAGING DISTURBANCES

Interbio will provide its best effort in order that the use of our website is protected from disturbances such as including but not limited to virus and malware. We will notify you in writing in the event of a system failure and/or failure in connection with the processing of the Personal Information no later than 14 (fourteen) days after the discovery of the disturbance and/or failure.

9. YOUR RIGHTS

Under applicable law, and subject to limitations and exceptions provided by law, you may have certain rights related to your Personal Information, including the right to:

  1. Obtain the information concerning of clarity of identity, legal basis, usage of Personal Information and accountability of party requesting Personal Information, including but not limited to whoever has accessed your Personal Information;
  2. Access request: You can receive the copy of your personal information and check that we lawfully process it;
  3. Correction request: You can correct incomplete or inaccurate data (verification needed);
  4. Removal request: You can ask to delete your Personal Information when there is a necessary consideration. Please note that we may not always comply with your request for certain legal considerations which will be notified to you;
  5. Withdrawal of consent: If you wish to withdraw your consent to any use or disclosure of your personal information, including request to stop, to limit and to postpone the processing of data, you may contact us to marketing@interbio.id;
  6. Obtain written notification from Interbio at the latest for 3×24 (three times twenty-four) hours in condition that there is a failure of Personal Information protection;
  7. Access collected Personal Information about you;
  8. Request that we rectify or update your Personal Information that is inaccurate or incomplete;
  9. Request, under certain circumstances, that we restrict the processing of or erase your Personal Information;
  10. Object to our processing of your Personal Information under certain conditions provided by law;
  11. Request complain for decisions which based on automatic processes, profiling, any actions which arising legal consequences or has a significant effect for owner of Personal Information.

10. WAIVER

Interbio shall only be liable for any loss or damage suffered by the User which is proven to have been caused by Interbio’s negligence or wilful misconduct. Users shall now and in the future indemnify Interbio against any claims, demands or judgements by any person not directly related to the use of this Privacy Policy.

11. GOVERNING LAW

The terms and conditions of this Policy are governed by the laws of Indonesia. In the event of any disputes arising from this Policy, you must first contact Interbio regarding your concern and use your best endeavours to amicably settle your concerns in good faith. Interbio will also use Interbio’s best endeavours to amicably settle your concerns in good faith. However, if no amicable solutions are reached within 30 (thirty) days, you agree the dispute shall be settled at South Jakarta District Court in Jakarta and use related Indonesian prevailing regulations.

12. MISCELLANEOUS

By accepting and providing consent to Privacy Policy for Interbio’s website, you are acknowledging that you have read and agreed to accept the Privacy Policy and all its terms and conditions.
